1. PURPOSE

The source code for Quill may be made publicly available for transparency and inspectability.

The source code is published so that users, researchers, security reviewers, developers, and other interested persons can inspect how Quill operates and independently evaluate claims concerning its privacy, security, network behaviour, data handling, and functionality.

Public availability of the source code does not make Quill open-source software.

Except for the limited permissions expressly stated in this License, no permission is granted to copy, modify, compile, build, redistribute, republish, sublicense, commercialise, incorporate, or create derivative works from Quill.

2. OWNERSHIP

Quill, including its original source code, application code, user interface, documentation, graphics, designs, configuration, and other original materials included in the Quill repository or application, are collectively referred to in this License as the "Quill Materials".

Except for third-party materials identified separately, the Quill Materials are owned by Tikmany ("Licensor") and are protected by applicable copyright and other intellectual-property laws.

All copyright and other intellectual-property rights in the Quill Materials remain with the Licensor.

Making the Quill Materials publicly accessible does not transfer ownership of them to any other person.

3. LIMITED PERMISSION TO INSPECT AND VERIFY

Subject to this License, you may:

(a) access and view the Quill source code as made publicly available by the Licensor;

(b) read and inspect that source code for personal, informational, educational, privacy-review, security-review, research, or verification purposes;

(c) make only those temporary, incidental, or technical copies reasonably necessary to access and inspect the source code through the platform on which it is published;

(d) discuss, describe, review, analyse, link to, or report findings concerning Quill; and

(e) download and retain copies of the Quill source code, and compile, build, package, sign, install, and run copies of Quill, solely to test Quill independently or to compare a reproducible build with the compiled Quill application distributed by or on behalf of the Licensor, subject to the following limits:

(i) The source code must remain unmodified except for changes to local build configuration strictly necessary to build, install, or run Quill for these purposes, such as SDK paths, signing configuration, and toolchain configuration, and the test instrumentation permitted by paragraph (ii). Local build-configuration changes must not add, remove, or alter application functionality.

(ii) Solely for independent testing, you may make source-code modifications strictly necessary to observe, record, or test Quill's behaviour, including adding diagnostic logging, tracing, or network-observation hooks. These modifications must be limited to test instrumentation and must not add or enhance functionality for use outside that testing. Instrumented builds must not be represented as unmodified or reproducible copies of the distributed application.

You may make and retain copies of the source code, permitted modifications, and resulting build artifacts only as reasonably necessary for these purposes, and install and run those builds only on devices or in testing environments you own or control.

Testing may include exercising Quill's normal functions, including recording dictation, obtaining transcriptions, and inserting text, to the extent reasonably necessary to evaluate its behaviour. This permission does not permit use of those builds as a substitute for the compiled Quill application distributed by or on behalf of the Licensor outside those testing activities.

This permission does not permit source-code modification beyond paragraphs (i) and (ii), redistribution of source code, modifications, or builds, or making Quill's application functionality available to others as a product or service.

You may discuss, describe, review, analyse, and report the results under Section 3(d).

These permissions are limited to inspection, analysis, and the independent testing and reproducible-build comparison expressly permitted by Section 3(e).

They do not grant permission to use the Quill source code to create, modify, compile, build, distribute, or operate software except where Section 3(e), another provision of this License, the mandatory terms of the hosting platform, or applicable law expressly permits it.

4. RESTRICTIONS

Except with the Licensor's prior written permission, and except for rights expressly provided by Section 3, Section 5, applicable third-party licences, or applicable law, you may not:

(a) copy, reproduce, mirror, republish, or redistribute the Quill Materials;

(b) modify, adapt, translate, alter, or create derivative works based on the Quill Materials;

(c) compile, build, package, sign, or distribute Quill or any modified or unmodified version of it;

(d) publish Quill or a version derived from Quill through an application store, package repository, software-distribution service, website, source-code repository, or other distribution channel;

(e) incorporate any portion of the Quill Materials into another application, service, library, product, project, or source-code repository;

(f) sell, sublicense, rent, lease, monetise, commercially exploit, or otherwise make the Quill Materials available as part of another product or service;

(g) use the Quill Materials as the basis for a competing, derivative, or substantially similar application or service;

(h) remove, obscure, conceal, or alter any copyright notice, attribution notice, proprietary notice, or licensing notice contained in the Quill Materials;

(i) falsely represent that you created, own, maintain, endorse, or are officially associated with Quill; or

(j) grant or purport to grant another person rights in the Quill Materials that you do not possess.

For clarity, the fact that source code can technically be downloaded, copied, forked, or modified does not by itself grant legal permission to do so beyond the rights expressly provided by this License, applicable hosting-platform terms, applicable third-party licences, or law.

5. HOSTING-PLATFORM RIGHTS

The Quill source code may be published through GitHub or another source-code hosting platform.

The terms of that platform may require the Licensor to grant the platform or its users certain rights necessary for hosting and operation of the platform, including rights associated with storing, displaying, accessing, reproducing, or forking publicly hosted repositories.

Nothing in this License is intended to withdraw, contradict, or restrict a right that the Licensor has necessarily granted under the applicable hosting platform's terms.

Where Quill is hosted in a public GitHub repository, users may therefore exercise those rights that GitHub's applicable terms expressly provide in relation to that public repository, including viewing and forking through GitHub to the extent provided by those terms.

Any such permission arises from and is limited by the applicable platform terms.

It does not constitute a general licence from the Licensor to independently modify, compile, build, redistribute, republish, sublicense, commercialise, or create derivative products from the Quill Materials outside the scope of those platform-required rights. The separate, limited permission in Section 3(e) remains applicable.

Except for those limited rights, all rights in the Quill Materials remain reserved.

6. NO OPEN-SOURCE LICENCE

Quill is proprietary software whose source code may be made available for inspection.

The Quill Materials are not licensed under an open-source licence merely because their source code is publicly accessible.

Descriptions such as:

do not grant permission to reproduce, modify, redistribute, sublicense, commercialise, or create derivative works from the Quill Materials.

Only permissions expressly granted by this License, applicable hosting-platform terms, applicable third-party licences, or applicable law apply.

7. THIRD-PARTY SOFTWARE

Quill contains, incorporates, or depends upon third-party software.

Third-party materials are not licensed under this License.

They remain subject to their respective copyright notices and licences.

Where a file, component, library, dependency, or other material is expressly identified as being licensed under the Apache License 2.0, CC0, or another third-party licence, that third-party licence governs that material.

Nothing in this License restricts any right that a third-party licence independently grants you with respect to the applicable third-party material.

Quill's Third-Party Open-Source Licences notice identifies applicable third-party software and licences.

8. NO IMPLIED RIGHTS

No licence or permission is granted by implication, estoppel, publication of the source code, availability of a repository, technical ability to copy the code, or otherwise.

All rights not expressly granted are reserved by the Licensor.

Permission granted for one purpose does not imply permission for another purpose.

9. PERMISSION FOR OTHER USES

Except as expressly permitted by Section 3(e), if you wish to:

Permission may be granted or refused at the Licensor's discretion and may be subject to separate terms, conditions, fees, or a separate licence agreement.

10. CONTRIBUTIONS

Unless the Licensor expressly states otherwise, publication of the Quill source code is not an invitation to submit source-code contributions for incorporation into Quill.

Bug reports, security reports, suggestions, issues, discussions, and other feedback are welcome where the repository or another official Quill channel permits them.

Submitting feedback does not transfer ownership of Quill to the person submitting it.

A proposed source-code contribution may be accepted only under contribution terms separately specified or agreed to by the Licensor.

Unless such terms are provided, you should not assume that submitting source code gives the Licensor permission to incorporate it into Quill.

11. TRADEMARKS AND BRANDING

The Licensor makes no trademark claim to the name "Quill". You may use the name to identify, discuss, or refer to the software and its source code. You may not present yourself as the author, maintainer, or an official source of Quill, or suggest that the Licensor sponsors, endorses, or is affiliated with you or your work.

12. DISCLAIMER OF WARRANTY

The Quill Materials and publicly available source code are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, security, or error-free operation.

The purpose of publishing the source code is to permit inspection and the verification expressly permitted by Section 3(e).

You are responsible for any conclusions you draw from inspecting or analysing the source code.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, exemplary, or other damages arising from or relating to access to, inspection of, reliance upon, or unauthorised use of the Quill Materials.

The Licensor's total aggregate liability arising out of or relating to this License or the Quill Materials shall not exceed Rs. 100 (Rupees One Hundred Only).

Nothing in this License excludes or limits liability that cannot lawfully be excluded or limited.

Permissions granted to you under this License terminate automatically if you materially violate its terms.

Nothing in this License is intended to restrict any right that applicable law does not permit the Licensor to restrict.

This includes applicable statutory exceptions and limitations to copyright law.

16. RELATIONSHIP TO THE QUILL TERMS OF USE

This License governs access to and use of the publicly available Quill source code.

The Quill Terms of Use separately govern installation and use of the compiled Quill Android application distributed by or on behalf of the Licensor.

A licence to use the compiled application does not grant source-code rights beyond those provided by this License.

Likewise, permission to inspect the source code under this License does not grant permission to distribute or operate compiled copies of Quill, except for the limited permission to operate verification builds under Section 3(e).

17. GOVERNING LAW AND JURISDICTION

This License is governed by the laws of India.

Subject to any non-waivable rights under applicable law, the courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction over disputes arising out of or relating to this License.

18. SEVERABILITY

If any provision of this License is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall continue in effect.

19. ENTIRE LICENCE

This License states the permissions granted by the Licensor with respect to the Quill Materials.

Any additional permission, exception, commercial licence, modification right, distribution right, or other licence concerning the Quill Materials must be granted expressly in writing by the Licensor.

This License does not supersede an applicable third-party licence or a mandatory right arising under applicable law or hosting-platform terms.
