QUILL — TERMS OF USE

1. AGREEMENT
------------

These Terms of Use ("Terms") are an agreement between you and Mr. Tikmany, an individual developer based in Mumbai, India ("we", "us", "I").

By installing or using Quill you accept these Terms. If you do not accept them, do not use the app.

You must be at least 18 years old, or the age of majority where you live, and legally capable of entering into a contract.


2. WHAT QUILL IS
----------------

Quill is a bring-your-own-key (BYOK) voice-dictation tool.

It records short audio clips on your device, sends them directly from your device to a third-party speech-to-text provider that you choose and authenticate with your own API key, and inserts the returned text into the app you are using.

An optional clean-up step sends the transcribed text to a chat model through Groq, using your Groq key, to tidy the transcription.

Quill has no account system and operates no backend server that receives your dictation audio, transcripts, or API keys.

Quill does store certain information locally on your device, including encrypted API keys and, depending on your settings, dictation history and other local app data, as described in the Privacy Policy.


3. YOUR PROVIDER ACCOUNT AND YOUR KEYS
--------------------------------------

Supported configurations are:

  - Groq
  - OpenAI
  - OpenRouter
  - Google (Gemini API)
  - a custom OpenAI-compatible endpoint you specify

You obtain your own account and API key directly from the provider.

Your relationship with that provider is governed by the provider's terms and privacy policy, not by these Terms. Quill is not a party to that relationship.

You are responsible for all usage, charges, rate limits, and quota consumption associated with your keys.

Some providers offer free tiers with limits or different data-handling terms, while others charge per use.

Quill may help identify whether a key works and may hide models that appear unavailable to your key, but Quill cannot see or control your provider billing and we are not liable for charges billed to you by your provider.

By saving a key, you authorise Quill to make requests to that provider on your behalf from your device, including a small silent test request used to validate the key.

If you configure a custom endpoint, you are solely responsible for that endpoint, including its security, behaviour, availability, and what it does with the audio, text, and authentication credentials you send to it.

Keep your API keys confidential.

Keys are stored encrypted on your device, but you are responsible for your device's security and for rotating a key if you believe it has been compromised.


4. PERMISSIONS AND THE ACCESSIBILITY SERVICE
--------------------------------------------

Quill uses an Android accessibility service solely to detect the focused text field and insert your dictation into it. Android provides no standard API for a third-party app to detect the focused text field in another app or insert text into it without replacing your keyboard, so an accessibility service is required for this to work.

Quill also uses an overlay and microphone foreground service to display its floating bubble and record while you are using another app.

Each is enabled only after the applicable in-app disclosure and your explicit consent, and you can revoke applicable permissions at any time through Android system settings.

Quill refuses to type into fields Android identifies as password inputs.

Quill does not use the accessibility service to read screen content, log keystrokes, or collect data. Quill does not work around Android's privacy controls, does not change system settings without your permission, and does not use deceptive interface practices. The full accessibility service disclosure is set out in the Privacy Policy.


5. ACCEPTABLE USE
-----------------

Use Quill lawfully.

Do not use Quill:

  - to record any person or audio you have no right to record;
  - to violate another person's rights;
  - to breach your provider's terms;
  - to access or input content into systems you are not authorised to use; or
  - for any other unlawful purpose.

You are responsible for the content you dictate and for where you insert it.


6. ACCURACY — REVIEW BEFORE YOU RELY
------------------------------------

Speech recognition and AI clean-up are imperfect.

Transcripts may contain errors, omissions, or, when clean-up is enabled, rewording.

Always review inserted text before sending it or acting on it.

Do not use Quill as the sole input method for safety-critical, medical, legal, financial, or other high-stakes content.

Where the accuracy of a field matters, verify it before relying on it.


7. THIRD-PARTY SERVICES
-----------------------

Provider availability, accuracy, pricing, latency, and data handling are outside our control.

Providers may change or discontinue their APIs at any time.

Quill may stop working with a particular provider or model without notice if that provider changes its service.

We may add or remove supported providers and models in app updates.


8. UPDATES; INTERFACE TEXT
--------------------------

We may update Quill from time to time.

Quill may also fetch a cryptographically signed bundle of interface wording, including labels, help text, and translations, without requiring a full app update.

This mechanism cannot change these Terms, the Privacy Policy, the Quill Source Code License, or any privacy, consent, or disclosure wording fixed into the app binary.

These Terms may be revised through an app update.

Continued use of Quill after an updated version containing revised Terms becomes applicable constitutes acceptance of the revised Terms.

If you do not accept revised Terms, stop using and uninstall Quill.


9. LICENCE AND INTELLECTUAL PROPERTY
------------------------------------

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the compiled Quill application on Android devices you own or control, in accordance with these Terms and applicable Google Play terms.

This end-user licence permits use of the compiled Quill application. It does not grant you ownership of Quill or any general right to Quill's source code.

If we make Quill's source code publicly available for inspection, that source code is separately governed by the Quill Source Code License published with the source code.

Except for rights expressly granted under these Terms, the Quill Source Code License, applicable third-party licences, or rights that cannot lawfully be restricted, all rights in Quill are reserved.

Quill includes third-party and open-source components identified in its third-party licence notices. Those components are licensed under their own respective terms, and nothing in these Terms or the Quill Source Code License restricts rights independently granted by those licences.

You retain all rights to your dictated content.

We claim no ownership of your dictated content and do not operate a backend server that receives it.


10. NO WARRANTY
---------------

Quill is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Device manufacturers' battery-management behaviour may interrupt Quill's bubble or recording functionality, and we do not warrant against this.


11. LIMITATION OF LIABILITY
---------------------------

To the maximum extent permitted by applicable law:

(a) we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, or goodwill;

(b) we are not liable for provider charges, provider data handling, mis-transcribed or mis-inserted text, or content you send anywhere using Quill; and

(c) our total aggregate liability arising out of or relating to Quill shall not exceed Rs. 100 (Rupees One Hundred Only).

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.


12. INDEMNITY
-------------

You agree to indemnify us against claims arising from:

  - your unlawful use of Quill;
  - your breach of these Terms; or
  - your breach of a provider's terms.


13. TERMINATION
---------------

You may stop using Quill at any time by uninstalling it.

We may suspend or terminate distribution or support of Quill at any time.

Sections 5–6 and 9–15 survive termination to the extent necessary to give them effect.

Termination of your right to use the compiled Quill application does not alter copyright ownership or the separate terms governing any publicly available Quill source code.


14. GOVERNING LAW AND DISPUTES
------------------------------

These Terms are governed by the laws of India.

The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to any non-waivable consumer-protection or other rights applicable in your place of residence.


15. SEVERABILITY; ENTIRE AGREEMENT
----------------------------------

If any provision of these Terms is held invalid or unenforceable, the remainder remains in effect.

These Terms and the Privacy Policy constitute the entire agreement between you and us concerning your installation and use of the compiled Quill application.

If Quill source code is made publicly available, that source code is separately governed by the Quill Source Code License published with it.

Nothing in this section supersedes, replaces, expands, or limits:

  - the Quill Source Code License as it applies to Quill source code;
  - third-party licences applicable to third-party components; or
  - rights that applicable law does not permit us to restrict.
